This website has been established only to assist user(s) to engage themselves in business transactions that have the capability of being rendered and delivered via online in our hustle free and well secured cyber environment. This website is for no other purpose than this. All activities of a user of the website must have bearing on digital related service(s) that are spelt out within the confinement of these terms and conditions.

The following Terms of Service (these “Terms of Service”, “Terms and Conditions” or “Terms of Use” as used interchangeably), govern your access to and use of the OttoFixter website, including any content, functionality and service offered on or through www.ottofixter.com by OttoFixter Inc., as applicable. OttoFixter Inc., referred hereto as “OttoFixter”, “we” or “us” and “you” or “user” means you as a user of the site.

Subject to the license, all of these intellectual property rights are reserved.
You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms of use.
You must not:

(b) sell, rent or sub-license a copyright material from the website;

NB: If a user’s account shows signs of fraud, abuse or suspicious activity, OttoFixter may banned the account without giving prior notice to the account holder.

MAIN TERMS
1. OttoFixter is opened to everyone. Registration is free.
2. A user may be required to go through a verification process in order to use the Site (whether by using email, ID, phone number, camera, etc).
3. A verified registered user can buy or sell any digital related services on ottofixter.com that are within our frameworks.
4. A user whose account might be under suspicion must be able to verify the account ownership providing materials that prove ownership of that account before granting access.
5. A user’s profile contains editable information about the user. The profile page must be kept in its true sense free from misleading or false information. It must be the true representation of the user.
6. Price of an enlisted service is determined by the seller under the monitoring of OttoFixter to make it free from exploitatory designs and exorbitance.
7. Buyer-to-Seller payment is an escrow system managed. This is to make both parties secured in every financial transaction. For payments, fees and taxes read more here.
8. Users must not offer or accept payments using any other method than placing an order through www.ottofixter.com
9. Our dispute platform is to help resolve issue(s) arising between a user and a user and/or a user and ottofixter.com. For disputes, read more here.
10. OttoFixter retains the right to use all published services, logo designs and/or testimonials of a user for OttoFixter marketing and promotion purposes.
11. OttoFixter does not provide any guarantee of the level of service a seller offers to a buyer.
12. OttoFixter does not provide protection for users who interact outside of the ottofixter’s platform. All information and file exchanges must be performed exclusively on ottofixter’s platform.
13. Communication between users and/or user(s) and OttoFixter must be friendly, constructive, and professional.
14. As a user, never reveal your password, bank account information and/or credit/debit card details to neither another user nor OttoFixter Inc. (Buyers are advised to buy from sellers that use their own documents in rendering their services).
15. A banned account will have its all available funds frozen and will only be released after six(6) months if only the user of such account is verified as the rightful owner of the account and funds in question.
16. Any prices which are quoted from time to time on our website are indicative and subject to change and may be stated incorrectly.

GENERAL RESTRICTIONS
Violation of any of the restrictions below may call for direct warning, suspension or removal of a user account. Our system monitors all activities and may act on the slightest suspicion automatically;
1. Rude, abusive, improper language, or violent messages are not allowed.
2. User interaction must be free from discrimination based on gender, race, age, religious affiliation, sexual orientation and suchlike. Such detected discrimination may result in the suspension/removal of a user’s account without any warning.
3. Luring of a user to reveal personal details; passwords, bank account and credit card information is prohibited. Phishing is prohibited. (Users are highly advised not to buy services from sellers who ask for such information).
4. Posting or publishing or using another user’s personal information; age, date of birth, marital status, educational background, financial status, sexual orientations, religious affiliations and suchlike information that may be deemed as confidential, top secret or classified material, for any other purpose other than the purpose upon which such information were released from the owner to aid service delivery, is highly prohibited unless under the permission of the user whose information is in question.
5. Brand assassination is not tolerable in any way and users are advised not to practise such in connection with OttoFixter.
6. Spamming activities by a user would warrant us to put restrictions on the account.
7. User is restricted to be off from any activity (writing or pictures or films etc.) which has no literary or artistic value other than stimulating sexual desire. All adult oriented or porn contents are prohibited.

REFUNDS
OttoFixter provides full refund of your payment in the following cases:

1. When you stably encounter an error which is preventing you from using our platform properly, and if we are not able to correct the error within 30 days. Evidence of detailed information about the error may be required.
2. If a user accidentally buys a service more than once.
3. If a user becomes a victor in a dispute.
4. If a user cancels an order in progress under the right conditions that may not call for disputes.

NB: Refunds takes 3 up to 7 business days to reach the targeted account and all funds are expressed in USD. The exchange rate to a user’s local (or preferred) currency is determined by the user’s bank, not OttoFixter.

DISPUTES AND ARBITRATION
1. USER vs USER
Users must try and settle conflicts among themselves. If for any reason this fails, our dispute feature may be used to call for the attention of our arbitrators to help resolve the conflict.
If a user is not satisfied with the verdict of our arbitrators or our arbitrators fail to resolve the issue within a maximum period of 90 days, then a user may forward the case number to panel@ottofixter.com for review which takes 3 days up to 21 days for resolution. A user still unsatisfied may pursue claims 30 days after the elapsed of the 21 day resolution process.

2. USER vs OTTOFIXTER (and vice versa)
An unsatisfied user who has issue with ottofixter.com may contact our panel unit via panel@ottofixter.com and raise the grievance(s) in a clear and coincise tone and possibly make it evidential. A member of the panel will be assigned to resolve the issue with the user within a maximum period of 21 days. Likewise, ottofixter.com will contact a user and lay down any grievance(s) against such user to call for resolution within a maximum period of 21 days.
If perhaps, that becomes unsuccessful in any of the scenarios, then the user or ottofixter.com may pursue claims 30 days after the elapsed of the 21 day resolution process.

PRIVACY RIGHTS
We may transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms of use without notifying you or obtaining your consent.
We may disclose your data to our affiliated organisations and subsidiaries, and to service providers who render services to us or you on our behalf (all of which are contractually obligated to act only on our instructions and in accordance with applicable laws, including GDPR).
We also may disclose your information if required by law, requested by law enforcement authorities or to enforce our legal rights, such as pursuant to a subpoena. We may share your information in connection with a sale or reorganisation of OttoFixter, but in any such case, the terms of condition will continue to apply.

LIMITED WARRANTIES
In spite of the fact that OttoFixter Inc., runs and maintains ottofixter.com with maximum effort to ensure that all mechanisms and functionalities are good in shape to render its intended services, we do not warrant its completeness and/or accuracy, nor do we commit to that the website remains up-to-date, fully functional or available all the time.
Users are to be aware that, ottofixter.com might face issues as unforeseen circumstances and other occurrences that might be beyond our control could result in delay, bad display, non-performing, lagging in updates, inaccuracy and/or unavailability of our website. Factors such as jurisdictional permissions, technical issues, cyber attacks, hacking, technological virus invasion, failure of servers, internet shut down, wars, natural disasters, etc could render us out of service either temporary or permanently. Therefore a user using the site does so at his/her own risk after agreeing to go by these Terms of Use.

NOTE: The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.

LIMITATIONS AND EXCLUSION OF LIABILITY
1. Nothing in these terms of use will:
(a) limit or exclude our or your liability for death or personal injury resulting from negligence;
(b) limit or exclude our or your liability for fraud or fraudulent misrepresentation;
(c)limit any of our or your liabilities in any way that is not permitted under applicable law; or
(d) exclude any of our or your liabilities that may not be excluded under applicable law. If you are a user, any statutory rights which you have, which cannot be excluded or limited, will not be affected by these terms of use.
2. The limitations and exclusions of liability set out in this section and elsewhere in these Terms of Use:
(a) are subject to the preceding paragraph; and
(b) govern all liabilities arising under the terms of use or in relation to the subject matter of the terms of use, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.
3. We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
4. We will not be liable to you in respect of any financial losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.
5. We will not be liable to you in respect of any loss or corruption of any data, database or software.
6. We will not be liable to you in respect of any special, indirect or consequential loss or damage.

VIOLATIONS
Without prejudice to our other rights under these Terms of Use, if you breach these terms of use in any way, or if we reasonably suspect that you have breached these terms of use in any way, we may:
(a) send you one or more formal warnings;
(b) temporarily suspend your access to the website;
(c) permanently prohibit you from accessing the website;
(d) block computers and/or devices using your IP address from accessing the website;
(e) contact your internet services provider and request that they block your access to the website;
(f) suspend and/or delete your account with the website.

REPORTING INFRINGEMENT(S)
Any content from OttoFixter and/or a user that may violate these Terms of Use spotted by a user, should be reported to panel@ottofixter.com

INDEMNITY
You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses (including without limitation to legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of legal advisers) incurred or suffered by us arising out of any breach by you of any provision of these terms of use, or arising out of any claim that you have breached on any provision of these terms of use.

LINKS TO THIRD PARTY SITES
www.ottofixter.com may contain hyperlinks to other third party sites. A news blog, newsletters, photos, videos, user review, user comment, advertisement if any, and many others may have such hyperlinks. A user that sells service(s) via ottofixter.com platform too might include the url to their own respective websites. A user clicking on any of such hyperlinks must know that, OttoFixter do not control such websites and not responsible for their content including but not limited to their Privacy Policy, Terms of Use, etc

Further, its up to the user to take precautions to ensure that such websites is free from destructive materials such as viruses, worms, trojan horses and other defects. Our inclusion of hyperlinks and/or our permission for hyperlinks to be used on our site does not imply our endorsement of any content on such websites.

EXCLUSION OF THIRD PARTY RIGHTS
These terms of use are for the benefit of you and ottofixter.com, and are not intended to benefit any third party or be enforceable by any third party. The exercise of our and your rights in relation to these terms of use is not subject to the consent of any third party. OttoFixter is not responsible for contents on external websites.

SEVERABILITY
If a provision of these terms of use is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

ENTIRE AGREEMENT
These terms of use, together with our privacy policy, constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website.

VARIATION
